§1 Scope of Application
(1) These Terms of Service (hereinafter referred to as "TOS") apply to all content, functionalities, and services provided by the operator through the service "GGBot" (hereinafter referred to as "Service").
(2) By using the Service, the user (hereinafter referred to as "User" or "you") agrees to be bound by these TOS. Deviating terms and conditions of the User shall not apply unless expressly approved in writing by the operator.
§2 Nature of the Offering
(1) GGBot is provided as a free and non-commercial project. The use is voluntary, non-binding, and without contractual obligation.
(2) There is no entitlement to specific functionalities, content, or permanent availability of the Service.
§3 Subject Matter of the Service
(1) The Service offers an interactive application that enables users to perform automated interactions and outputs, particularly within online gaming environments.
(2) The scope of features and content may be modified, expanded, or discontinued at any time without prior notice.
§4 Eligibility
(1) The use of the Service is permitted exclusively to natural persons who are at least 18 years of age.
(2) Minors may only use the Service with the express consent of a legal guardian.
(3) By using the Service, the User warrants compliance with these requirements.
§5 Permitted and Prohibited Use
(1) The Service may only be used for lawful purposes and in accordance with these TOS.
(2) In particular, the following actions are prohibited:
- (a) using the Service to commit or promote unlawful acts or to violate applicable laws and regulations;
- (b) creating, distributing, or supporting content that is illegal, defamatory, violent, discriminatory, obscene, or morally objectionable;
- (c) publishing or spreading false or misleading content, including "fake news";
- (d) engaging in activities prohibited by the respective online gaming platform's rules;
- (e) excessive, automated, or systematic use of the Service (e.g., scraping, botnets, spam);
- (f) impersonation of others, deceptive conduct, or circumvention of technical protection measures.
(3) The operator reserves the right to take technical and legal measures in the event of violations, including blocking or permanently disabling the User’s access to the Service.
§6 Intellectual Property and Usage Rights
(1) All rights to the software, text, design, data, and other elements of the Service remain with the operator or its licensors.
(2) Use is limited to the functionality provided within the scope of the Service. Any use beyond this requires the express written consent of the operator.
(3) Commercial use of the Service is strictly prohibited.
§7 Disclaimer and Availability
(1) The operator does not guarantee uninterrupted, error-free, or permanently available access to the Service.
(2) The Service is provided "as is". Use is at the User’s own risk.
(3) The operator shall be liable without limitation only for intent and gross negligence as well as for injury to life, body, or health. In cases of slight negligence, liability shall be limited to foreseeable damages typical for the contract. Any further liability is excluded.
§8 Amendments to the TOS
(1) The operator reserves the right to amend these TOS at any time if there is a legitimate interest in doing so.
(2) Changes will be made known to the User in an appropriate manner. Continued use of the Service after the changes take effect constitutes acceptance of the amended TOS.
§9 Final Provisions
(1) These TOS shall be governed exclusively by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
(2) If the User is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction shall be the registered office of the operator.
(3) If any provision of these TOS is or becomes invalid in whole or in part, the validity of the remaining provisions shall remain unaffected. An effective provision that most closely reflects the intended purpose shall replace the invalid provision.
